BOOKING FEE/ DEPOSIT
A non-refundable booking fee of £400 is charged when the client signs the booking form, this fee is deducted in full from the total price.
Following payment of the deposit, the remaining balance will be required at least 21 days prior to the ceremony. Should this payment not be received by the day of the wedding the company reserves the right not to proceed with their services.
All books/albums to be delivered within mainland UK are inclusive of postal charges. Overseas delivery will require a courier uplift for which the full fee will be payable.
TERMS AND CONDITIONS
1. It is agreed that the terms set out in this booking form are the total agreement made between the parties and that no variation or modification of this form shall be effective unless agreed by both parties in writing.
2. SPECIAL REQUEST/COVERAGE
The client understands and accepts that the photographic coverage will be as the photographers professional expertise determines and that no one photograph will be deemed more important than another. Special requests are not binding instruction, although every effort is made to comply with the client’s wishes. Any special requests not notified on this booking form must be made by the client to the photographer in writing
3. THE PHOTOGRAPHER
On occasion it may be necessary for the photographer originally specified to be substituted for another photographer (e.g due to ill health) In the event that the client selects a package where two photographers are required, the named photographer will be assisted by a freelance photographer employed by the photographer and considered by the photographer to have the appropriate level and type of skills to replace the named photographer.
The photographer will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man made fibres. It is sometimes impossible to record the exact colours seen by the human eye.
Retouching, digital manipulation and artist finishing is available to the client as an optional extra. For the avoidance of doubt, editing of all images to a print ready standard by the photographer is included within the total price. This clause relates to any specific request by the client to materially alter the content of any image from that captured on the wedding day.
Any images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the act to copy or allow to be copied photographically/electronically or by an other means an image created as part of this contract without the permission of the photographer in writing. The client will be provided with a digital download containing the final edited high resolution images for their own personal (inc. social media sharing, print making etc) use only.
7. NEGATIVES DIGITAL FILES
Negatives/Digital files will remain the property of the photographer unless otherwise agreed.
We aim to have the proofs online and ready to be delivered within 28 days of the wedding although this may be slightly longer in busy periods.
9. ALBUM SELECTIONS
Selections must be received within 12 months of images being delivered or an additional fee of £250 will be charged before final production. On receiving the album selections and after discussion with the client on any particular layout or retouching requests they may have, we will create an electronic draft of the album. Any changes required to this draft will incur a fee of £25 per hour if changes are complex.
Free offers or added extras such as prints or albums must be claimed within 12 months of the wedding or the offer will no longer be valid.
The photographer shall be granted complete artistic licence including in relation to poses photographed and locations used. The photographer’s judgement regarding locations/poses and number of images taken shall be final. Due to the vagaries of the weather and the willingness of subjects it may not be possible to capture all the images requested.
Although the photographer will do his best to produce more preview prints than set out in example packages discussed with the client, there is no guarantee that any particular number of previews will be produced
The client hereby allows the photographer to display any images included in this contract in studio, portfolio, web site, literature, wedding exhibition and advertising. No use of the images containing recognisable characters will be made by the photographer for other commercial reason except with the written permission of the client.
14. FORCE MAJEURE OR ACT OF GOD
The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.
Subject to the terms of clause 14, the client may cancel this contract at any time by giving written notice to the photographer but in doing so shall forfeit any monies paid. Should cancellation of this contract by either party or in any other circumstance take place the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.
Any complaints should be raised by the client with the photographer in writing, within 28 days of first becoming aware of the matter to be complained of and in any event within 28 days of receipt of the images.
17. EVENING COVERAGE
The coverage will last until the first three dances, however if timings go beyond 9pm, an additional fee of £100 per hour will apply.
18. TRAVEL EXPENSES
For locations more than 50 miles from Edinburgh, Glasgow or St Andrew’s, a travelling fee of 45p per mile may apply to prior site visits and weddings.
